In group lottery wins splitting the spoils tough

WASHINGTON (AP) ? Every once in a while a lottery jackpot becomes so huge that people can't help but band together in the hope of increasing their odds, pooling their money for a wad of tickets and promising to evenly split the spoils. Seems like a good idea until lightning strikes and the group wins.

Then the future involves not only luxury, but also lawsuits. Numerous group winners have been sued by people claiming to have pitched in for the ticket, creating messy fights over what money will be left once the attorneys are paid. And most state lotteries don't give much official guidance on how to avoid such problems.

On Monday, rumors swirled about the three people holding winning tickets from the record-breaking $656 million Mega Millions drawing Friday night.

Kansas, Illinois and Maryland each have a winner. But as of Monday night, no one ? individual or group ? had yet stepped forward.

The New York Post reported that one potential winner in Maryland was a McDonald's employee who claimed to hold the winning ticket as an individual, but also bought tickets for several people as part of a restaurant pool. If the woman does indeed have a winning ticket, it could trigger just the latest group lottery lawsuit.

Maryland Lottery spokeswoman Carole Everett says the agency doesn't put out any information for groups, though she recommends friends and colleagues who play together come up with a system, including copying and distributing the group tickets to pool members and making a list of people who are participating.

"That way there's no confusion or mistaking it," she said.

In Illinois, where one of the three winning tickets was purchased in the small town of Red Bud, Lottery spokesman Mike Lang also recommended advanced planning to stave off disputes.

"There have been disputed wins in just about every lottery in the country," Lang said.

That's when lawyers get involved.

New Jersey attorney Rubin Sinins recently represented five construction workers who claimed a colleague, Americo Lopes, cheated them out of their share of a $38.5 million Mega Millions jackpot in 2009. The group was part of a weekly lottery pool, but Lopes claimed he bought the winning ticket for himself. A unanimous jury in New Jersey decided otherwise in March and awarded the construction workers $4 million each. Sinins said his advice to people participating in an office pool is to "use common sense."

Resolving disputed group winnings can take years.

In 2010, colleagues at a Florida country club won $16 million in the state lottery but soon faced a lawsuit from one regular pool member who wasn't at the club the day money was collected for the tickets. Jeanette French played the lottery with colleagues for nine years, though the members of the group changed over time. Seven group members claimed the winning ticket, but a lawyer for French got her claimed portion of the winnings set aside in a trust which the two sides are now fighting over.

One of French's attorneys, Miami lawyer Eric Shane, suggested that pool participants establish written rules and consider having each player sign the rules. He also suggested trying to keep pool members consistent. But his real advice?

"My true advice, honestly, would be don't do a pool," Shane said.

Retail Construction Starts will Stay at Record Lows until Debt ...

The recent opening of Taubman Centers? new mall in Salt Lake City might have marked a nice symbolic moment for the retail real estate industry, but it?s not about to usher in a new era of construction abandon.

In spite of a slight?rebound in retail real estate fundamentals, U.S. developers still feel skittish about investing in new?construction projects, forecasts from several different research sources show.

The CoStar Group, a Washington, D.C.-based firm, estimates that in 2012, a total of 21.4 million sq. ft. of new retail space will enter the market, a record low figure, according to Suzanne Mulvee, CoStar?s senior real estate economist. Mulvee notes that next year promises to be only slightly better in terms of deliveries of new space, largely due to the fact that retailers are not expanding the way they once had.

?This is a paradigm shift, a shift to growing revenue primarily through online sales versus growing revenue through physical locations,? she notes.

As a result of the difficulty of getting tenants to pre-lease space in new construction projects, lenders prefer to stay away from retail construction loans, while developers don?t want to invest as much equity as they need to put shovels in the ground. Exceptions can be found only in core cities with strong income growth and substantial tenant interest in opening new stores, according to Bill Rose, director of the national retail group at Marcus & Millichap Real Estate Investment Services, an Encino, Calif.-based brokerage firm.

Marcus & Millichap forecasts 32 million sq. ft. in new retail completions this year, down from approximately 35 million sq. ft. in 2011.

?In strong gateway markets, there is an appetite for financing new projects?provided they?ve got a good credit tenant base,? Rose says. ?There are projects getting financed in Washington, D.C., Baltimore, New York and Houston, but they need a good story and a good tenant mix. If you are saying to the lender ?can we get a deal done somewhere in Wisconsin?? the answer is ?Probably not.??

Light at the end of the tunnel?

In addition, most of the centers getting built today involve necessity retail?grocery-anchored shopping centers, centers anchored by drug stores and discount stores and net leased fast food restaurants, Rose adds. Construction of new malls and lifestyle centers remains on hold. But today?s developers are cautious on all projects, not just those reliant on discretionary spending dollars.

Reis, a New York City-based research firm, estimates that there will be 8 million sq. ft. in new neighborhood and community shopping centers delivered to the market in 2012. The figure will be higher than the annual average of 4.7 million sq. ft. of new construction in 2010 and 2011, according to Victor Calanog, vice president of research and economics. But the prior 10-year average for annual completions of neighborhood and community shopping centers was 29 million sq. ft., he points out.

?Developers are certainly paying attention to weak fundamentals with their hesitancy in bringing product to market,? he notes.

Research firm Trepp has updated its Commercial Mortgage Maturities outlook with fourth quarter 2011 data. It now estimates that $362 billion of commercial real estate debt will be maturing in 2012 (up from $346 billion in 2011). For the five year period 2012 to 2016, the estimate is $1.73 trillion of commercial real estate maturities.

In fact, new construction will remain anemic until the industry works through the record amount of debt maturities scheduled to come due between 2012 and 2016, according to Rose. Given the hundreds of millions of square feet of retail space that was delivered in 2006, 2007 and 2008 (approximately 507 million in all, in CoStar?s estimates), there is no shortage of available space for retailers to choose from right now. That means that in the near term, new project completions are not likely to rise above the 35 million sq. ft. a year figure, in Rose?s view. Eventually, however, the industry will see an uptick in new construction.

?That will occur post-2016, when all the legacy debt will clear the system,? Rose says.

(AP) ? Nguyen Huong Giang loves to party but loathes hangovers, so she ends her whiskey benders by tossing back shots of rhino horn ground with water on a special ceramic plate.

Her father gave her the 4-inch (10-centimeter) brown horn as a gift, claiming it cures everything from headaches to cancer. Vietnam has become so obsessed with the fingernail-like substance it now sells for more than cocaine.

"I don't know how much it costs," said Giang, 24, after showing off the horn in her high-rise apartment overlooking the capital, Hanoi. "I only know it's expensive."

Experts say Vietnam's surging demand is threatening to wipe out the world's remaining rhinoceros populations, which recovered from the brink of extinction after the 1970s thanks to conservation campaigns. Illegal killings in Africa hit the highest recorded level in 2011 and are expected to worsen this year.

This week South Africa called for renewed cooperation with Vietnam after a "shocking number" of rhinos have already been reported dead this year.

China has long valued rhino horn for its purported ? though unproven ? medicinal properties, but U.S. officials and international wildlife experts now say Vietnam's recent intense craving, blamed partly on a widespread rumor that rhino horn cures cancer, is putting unprecedented pressure on the world's estimated 28,000 remaining animals, mainly in South Africa.

"It's a very dire situation," U.S. Fish and Wildlife Service Director Dan Ashe said by telephone. "We have very little cushion for these populations in the wild."

Although data on the global rhino horn trade is scarce, poaching in Africa has soared in the past two years, with American officials saying China and Vietnam are driving the trade that has no "significant" end market in the United States.

Wildlife advocates say that over the last decade, rhino horn has become a must-have luxury item for some Vietnamese nouveau riche, alongside Gucci bags and expensive Maybach cars.

Between 2006 and 2008, three diplomats at the Vietnamese Embassy in Pretoria were linked to embarrassing rhino trafficking scandals ? including one caught on tape. In February, U.S. agents busted an alleged interstate rhino horn trafficking syndicate with Vietnamese-American ringleaders.

According to a court affidavit obtained by The Associated Press, Felix Kha, one of the alleged traffickers arrested in the recent U.S. bust, allegedly traveled to China 12 times between 2004 and 2011 and to Vietnam five times last year.

"There are still horns going into China but Vietnam is driving the increase in poaching for horns," said Chris R. Shepherd, deputy regional director for Southeast Asia at the wildlife advocacy group TRAFFIC. "Vietnamese authorities really need to step up their efforts to find out who is behind horn trafficking ... and put them out of business."

The rhino horn craze offers bigger payoffs than other exotic wildlife products such as bear bile or tiger bone paste. American officials say the crushed powder fetches up to $55,000 per kilogram in Asia ($25,000 per pound) ? a price that can top the U.S. street value of cocaine, making the hoof-like substance literally as valuable as gold.

The drive is so great, thieves are now pinching rhino horns from European museums and taxidermy shops, sometimes smashing them off with sledgehammers before fleeing. According to Europol, the European law enforcement agency, 72 rhino horns were stolen from 15 European countries in 2011, the first year such data was recorded.

Poachers in South Africa are also using chain saws to rip rhinos' horns off, mutilating the hulky animals while they're still alive and leaving oozing bloody cavities in the heads of those lucky enough to survive.

Sometimes, they simply shoot the beasts dead, even though the horns can grow back within two years without harming the animal if carefully cut. Officials and nonprofits in South Africa are preemptively cutting some rhinos' horns in an attempt to save them, but some poachers are killing anyway just for the nubs.

Vietnam wiped out its own last known Javan rhinoceros in 2010, despite the country's earlier efforts to protect it. The last of the population was found dead in a national park, shot through the leg with its horn hacked off.

Tran Dang Trung, who manages a zoo outside Hanoi that imported four white rhinos from South Africa, said he worries for the animals' safety even though the zoo has 24-hour security.

"If thieves wanted to kill the animals and steal their valuable parts, they could," Trung said recently outside the rhinos' basketball court-sized outdoor pen.

Laws in Vietnam surrounding the business of importing horns are murky and crackdowns are rare despite government pledges to root out traffickers.

Officially, no more than 60 horns are legally imported into Vietnam as trophies bagged from South African game farms each year, but international wildlife experts have estimated the actual number of trophy horns taken by Vietnamese nationals from South Africa each year may exceed 100.

Earlier this week, the South African government said it was working with the Vietnamese to stop the potential abuse of hunting permits. Hanoi has also been asked to conduct inspections to make sure rhino trophies imported from South Africa still remain in the hunters' possession.

It's impossible to track how other rhino horns are entering Vietnam, wildlife advocates say, but they point to local media reports suggesting Vietnamese diplomats are implicated in the international trade that's been largely banned since 1976.

In 2006, a diplomat at Vietnam's South African Embassy was arrested for trafficking rhino horn, while another was filmed two years later trading the substance outside the mission's gates. A third diplomat was also questioned that same year after 18 kilograms (40 pounds) of rhino horn was found in his car outside a casino.

In a statement, Foreign Ministry Spokesman Luong Thanh Nghi said those incidents reflected badly upon Vietnam's image, and that the diplomats all faced disciplinary measures.

Meanwhile, illegal rhino killings in South Africa are skyrocketing ? from 122 in 2009 to 333 in 2010 and a record 448 in 2011. The country reported last week that 150 rhinos had already been poached this year, nearly 60 percent taken from Kruger National Park.

In Hanoi, Vietnamese buy rhino horn on the streets of the city's bustling old quarter, where a traditional medicine dealer recently told the AP that the average prescription costs 200,000 dong ($10).

Hanoi doctors report that some of their clients take the powder as a supplement to western medicines, believing it cures fever and other common ailments. Others use it as a last-ditch effort against cancer.

Nguyen Huu Truong, a doctor at Hanoi's Center for Allergy Clinical Immunology, said a handful of patients visit him each year complaining of rashes he links to rhino horn consumption.

"Many Vietnamese believe that anything expensive is good, but if you're going to spend a lot of money on rhino horn, you might as well bite your nails," he said. Rhino horns are composed of keratin, a protein found in human hair and fingernails.

Giang, the young Vietnamese woman who regularly uses rhino horn to prevent hangovers, says she's unfazed by doctors' assessments of the substance's efficacy and doesn't care to know how her father acquired the horn.

Experts say some rhino horns passing through Vietnam are fakes, and the AP couldn't verify the authenticity of Giang's horn, which she grinds on a plate with a rough finish made specifically for the task. She ingests the liquefied form when she has allergic reactions or after tippling on too much top-shelf liquor.

Because Giang only takes rhino horn shots once or twice every three months, she estimates her horn will last another 10 to 15 years. But once her stash is depleted, there may not be any rhinos left on earth to satisfy her craving.

Dr. Olson is known for his work at the interface of developmental biology and medicine that identified major genetic pathways controlling the formation of the heart and other muscles. Several drugs based on his research are currently under study.

The award is given annually by the Indiana University School of Medicine.

At UT Southwestern, Dr. Olson directs the Nancy B. and Jake L. Hamon Center for Basic Research in Cancer and the Nearburg Family Center for Basic and Clinical Research in Pediatric Oncology.

A member of the National Academy of Sciences and the Institute of Medicine, Dr. Olson will present a lecture to medical students, graduate students, postdoctoral researchers and medical residents on the Indianapolis campus Oct. 16, followed by the Beering Award lecture on Oct. 17. The award includes a medal and a $25,000 prize.

Several Beering awardees have gone on to win the Nobel Prize. 1990 Beering winner Dr. Alfred G. Gilman, UT Southwestern professor emeritus of pharmacology and chief scientific officer for the Cancer Prevention and Research Institute of Texas, was awarded a Nobel in 1994.

The Passano Foundation recently named Dr. Olson the winner of the 2012 Passano Award, a $50,000 prize created in 1943 to honor U.S.-based research that leads to real-world applications. Dr. Olson will accept that prize April 30 in Baltimore. Twenty-three Passano Award recipients have gone on to win the Nobel Prize including Dr. Gilman, Dr. Joseph L. Goldstein, chairman of molecular genetics; and his 1985 co-winner Dr. Michael S. Brown, director of the Erik Jonsson Center for Research in Molecular Genetics and Human Disease.

Revel, Atlantic City's newest casino set to open

(AP) ? Michael Garrity recalls sitting on a pile of dirt at the end of the Atlantic City Boardwalk in 2006 with Kevin DeSanctis, a former New Jersey state trooper and casino executive. Morgan Stanley, Garrity's Wall Street investment firm, had just lined up land for what would become Revel, a new casino resort.

The economy was humming along and Atlantic City's casino revenues were at their height. Yet sitting on that dirt pile, DeSanctis was already thinking several years ahead.

"He said, 'The last thing Atlantic City needs right now is a new casino,'" recalled Garrity, who is now Revel's chief investment officer.

So they set out to build something that was not just a casino but a true destination resort, a glittering glass-encased vacation and meeting mecca that just happened to offer casino gambling.

Monday morning, when the sun comes up, Revel will have arrived. A sunrise champagne toast will officially open the facility. Six years and $2.4 billion after the two men sat atop that dirt pile, it becomes Atlantic City's 12th casino ? one that is being counted on to help revive the sagging fortunes of the nation's second-largest gambling market.

"The real issue is: Can you maintain the interest and the excitement?" DeSanctis said. "If we can do that, then I'm not worried. This is going to be a great resort."

That was certainly the verdict from Margy Woolsey, an Atlantic City resident who was among 5,000 invitation-only guests last week for the first of three trial-run gambling nights at Revel, to see how equipment, systems and personnel would work under real-world pressures.

"It's got that wow factor," she said between a string of winning hands of electronic blackjack. "I usually play at Harrah's, but this is my place now."

Revel is Atlantic City's only non-smoking casino resort, and the only one to fully embrace the ocean, with floor-to-ceiling views of the coast that are considered a no-no in other gambling halls. It was designed to appear as if its foundation had been gently sculpted by waves, and a newly replenished beach is a key attraction.

Gambling is only part of the $2.4 billion resort; it also has a luxurious spa, 14 restaurants, 10 pools and a theater with 5,050 seats that will host Beyonc? on Memorial Day weekend.

It has 2,450 slot machines and 160 table games. Its hotel, when fully open later this year, will have 1,898 rooms. Revel will employ about 5,500 full and part-time employees.

Located at the extreme northern end of the Boardwalk, next to the Showboat Casino Hotel, Revel is the first Atlantic City casino to open since its main rival, the Borgata Hotel Casino & Spa, debuted in 2003. With its angular slanted roof and its giant white light-up ball atop the 47-story structure ? the second-tallest in New Jersey at 710 feet ? Revel is already an iconic presence here.

Revel had to overcome numerous obstacles in order to reach Monday's opening. Three key executives working on the project died in a Minnesota plane crash in July 2008; a worker pouring concrete was struck by lightning and killed last September.

The project ran out of money during the recession and had to stop construction halfway through. Morgan Stanley pulled out, taking a $1.2 billion loss on the project. It only got completed with the help of state tax incentives that were approved in February 2011. That came amid bitter opposition from the city's main casino union, which is livid that Revel has not signed a contract with its hotel and service industry workers, and filed several lawsuits seeking to thwart government assistance to the project.
